We proudly stand behind our products with a 1-Year Limited Manufacturer Warranty, applicable under the following conditions:

Limited Warranty for Akal Manufacturing, Inc. dba Defoe Furniture for Kids

1. Final Sale Policy

All products from Akal Manufacturing, Inc. dba Defoe Furniture for Kids are custom-crafted to your exact specifications and are produced to the highest standards of quality. Therefore, all sales are final, with no returns or exchanges accepted, as each item is made-to-order. Deposits are non-refundable.

· Cut List Approval: Once a cut list is approved in writing by the purchaser, any requested changes or modifications are subject to additional costs.

· Product Specifications: Products are fabricated precisely according to the specifications outlined in the approved cut list and Acknowledgment of Order.

· Saltwater Proximity Clause: Products installed within 500 yards (457 meters) of a saltwater shoreline are covered for half the period of the standard warranty (up to a maximum of five years) due to the corrosive effects of saltwater.

· Corrosion Disclaimer: Corrosion or deterioration resulting from exposure to environmental elements, including but not limited to sunlight, rain, saltwater, or salt spray, is deemed a natural occurrence of wear and tear. As such, it is expressly excluded from coverage under this warranty.

· Natural Disaster Disclaimer: Damage resulting from flooding, fire, earthquakes, or any other natural disasters or Acts of God is expressly excluded from coverage under this warranty.

Note: This policy ensures that all custom orders are final. No modifications, returns, or exchanges are allowed once production begins.

2. Custom Order Specifications

All custom orders are fabricated strictly according to the approved cut list provided by the purchaser.

· Post-Approval Changes: Any changes requested after written approval are subject to additional costs.

· Post-Delivery Modifications: Any modifications requested after delivery that deviate from the original approved cut list are the purchaser's responsibility, including all associated costs.

In the event that any provision of this Agreement is held to be invalid or unenforceable by a Court of competent jurisdiction, then such provision shall be deemed to be severed from this Agreement and the remaining provisions hereof will continue in full force and effect.

3. 4-Year Limited Manufacturer Warranty

Akal Manufacturing, Inc. dba Defoe Furniture for Kids provides a 4-Year Limited Manufacturer Warranty

on products fabricated and assembled on-site.

· Coverage: This warranty covers manufacturing defects in materials and workmanship.

· Claims Process: Warranty claims must be submitted in writing within 365 days of purchase. Upon receiving a valid claim, Akal Manufacturing Inc. will, at its discretion:

o Repair the defective part(s), or

o Provide a replacement part within 90 days of confirming receipt of written notification.

· Replacement Warranty: Replacement parts are warranted for the remainder of the original warranty period.

IMPORTANT: This warranty applies only if the product has been properly used and maintained. Proper maintenance is the purchaser's responsibility.

· 1-year Limited Warranty on Hardware Coverage: Hardware, including vinyl, metal, and nylon parts, is warranted for one (1) year from the date of sale for defects in manufacturing, materials, and workmanship.

4. Warranty Exclusions

This warranty does not cover the following:

· Products assembled off-site by the purchaser or any third party. Assembly by anyone other than Akal Manufacturing, Inc. dba Defoe Furniture for Kids voids the warranty.

· Damage resulting from misuse, abuse, negligence, accidents, or unauthorized modifications, or any other use than intended purpose, voids the warranty.

· Any cuts, painting, or finish work done after delivery voids the warranty.

· Akal Manufacturing dba Defoe Furniture for Kids or its affiliates are not responsible for Labor costs for removal, installation, or disposal of defective or replacement parts.

· Cosmetic issues, normal wear and tear, or damage from extreme environmental conditions, including saltwater corrosion voids the warranty.

· Natural variations in wood color or texture are not considered defects and the warranty will not apply.

5. Warranty Claims

To make a warranty claim, the purchaser must:

· Provide a written statement detailing the defect, including the original job number, purchase order number, or invoice number.

· Submit the claim within 365 days from the date of purchase to:

Upon receiving a valid claim, Akal Manufacturing Inc. will, at its discretion:

· Repair the defective part(s), or

· Provide a replacement part within 90 days of written notification.

Note: Manufacturer will deliver the repaired or replacement part(s) free of charge but will not be responsible for labor costs related to removal, installation, or disposal.

6. Disclaimer of Other Warranties

THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, whether expressed or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose.

7. Limitation of Liability

· The remedies provided under this warranty are the exclusive and sole remedies available to the purchaser.

· Akal Manufacturing, Inc. dba Defoe Furniture for Kids shall not be liable for any direct, indirect, special, incidental, or consequential damages.

· No employee, representative, or other person is authorized to assume any other liability in connection with the sale or use of the products.

· No oral agreements or warranties collateral to or affecting this agreement are recognized.

8. Terms of Warranty

This warranty is valid only if:

· Products are assembled by Akal Manufacturing, Inc. dba Defoe Furniture for Kids or its authorized personnel.

· Products are maintained according to the guidelines provided.

· Products are subjected to normal use for their intended purpose.

· No unauthorized modifications, alterations, or repairs are made.

· Products are not exposed to saltwater or salt spray.

· Products are not exposed exposure to environmental elements causing corrosion.

· Products are not Damage resulting from flooding, fire, earthquakes, tornados, or any other natural disasters or Acts of God

Improper Installation: Any installation or assembly by a party other than Akal Manufacturing, Inc. dba Defoe Furniture for Kids voids this warranty.

Governing Law: This limited warranty is governed by the laws of the State of California, without regard to its conflict of laws principles.

9. Legal References

This warranty complies with applicable legal requirements, including:

· Right to Repair Act: Covers functionality standards and "fit and finish" warranty requirements.

· California Business and Professions Code 7090a: Establishes liability for defects within four years of completion, in accordance with local codes and manufacturer’s regulations.

· California Civil Code Section 900: Requires a one-year limited warranty for the fit and finish of cabinets, mirrors, flooring, walls, countertops, paint finishes, hardware and trim.

11. Entire Agreement

This document constitutes the entire agreement between Akal Manufacturing, Inc. dba Defoe Furniture for Kids and the purchaser regarding the warranty. No oral agreements or modifications are recognized unless made in writing and signed by both parties.
